TERMS
Failure to comply with this agreement may result in termination of your account. Failure to pay
tolls may result in administrative fees and additional penalties, as provided by law.
TRANSPONDER USE
- You may use your Transponder(s) only on the vehicle(s) specifically listed on the application for
E-ZPass® use.
- You must approach and pass through dedicated E-ZPass® toll lanes at the posted speed
limit. Failure to obey the posted speed limit may result in suspension or revocation of your E-ZPass®
Transponder(s) and privileges.
- You must come to a complete stop at staffed tollbooths and only proceed on a green signal
unless otherwise directed, even if your vehicle is equipped with an E-ZPass®.
- You must comply with all applicable traffic laws, regulations, signs, signals, and directions of
toll collectors or law enforcement officers.
- You may not assign the obligations or benefits of this agreement to anyone else.
- This application, along with your remittance of any advance payments due in compliance with
these terms and conditions, establishes your E-ZPass® account. When you use your Transponder at
any E-ZPass® facility, you authorize us to debit your E-ZPass® account for such use.
- If you use E-ZPass® on other E-ZPass® facilities, you are subject to the laws and regulations
governing such use.
YOUR ACCOUNT
Your E-ZPass® account may consist of the purchase of Transponders and an advance toll payment as follows:
- Transponder Purchase. Business customers must purchase interior transponders at a cost of $24.60, or CVISN transponders at a cost of $40.00.
- Advance Payment. You must maintain an advance toll payment with us to cover applicable toll
charges on your E-ZPass® account. Tolls are deducted from your account each time the
E-ZPass® Transponder is used. We will also deduct applicable administrative fees incurred under this agreement.
- Account Balances. No interest will be paid on balances in your account.
ACCOUNT STATUS
If requested on your application, you may receive a periodic statement unless there were no
toll revenue transactions, and there was no financial activity, in the account during the applicable period.
METHOD OF ADVANCE TOLL PAYMENT
- Required Payment: You must pay a minimum advance toll payment sufficient to pay tolls for a
one-month period.
- E-ZPass® will perform an account analysis on all new accounts 35 days from the first use of tolls
and every 90 days thereafter. If your monthly use is consistently above or below your current
monthly payment, we will adjust your minimum payment to approximate one month’s level of
actual use. A "Replenishment Level Change" notification letter will be sent to you whenever we
adjust your replenishment level.
- You must replenish your account when your advance toll payment decreases to or falls below
the minimum required replenishment point. You may replenish your account in one of the following
ways:
- You may authorize us to replenish your advance toll payment by automatically charging your
credit card.
- By mailing checks (or money orders) made payable to E-ZPass®. A returned check fee of $25
will be charged for each check returned to us unpaid by your bank.
- By making cash payments in U.S. dollars at an E-ZPass® Service Center. DO NOT SEND CASH
BY MAIL.
VIOLATIONS
You authorize E-ZPass® to charge your account an administrative fee as follows:
- If you use your Transponder when your account is in a negative balance, is suspended or revoked, or
after your Transponder has been reported lost or stolen, you may incur an administrative fee of $15 for
each violation; be assessed civil penalties allowed by law for each violation and be charged the
full undiscounted toll.
- If you use a valid Transponder in a vehicle other than one of the class for which the Transponder is designated,
you may incur an administrative fee of $15 for each violation; be assessed civil penalties allowed
by law for each violation and be charged the full undiscounted toll. Such continued misuse may
also result in revocation of your account.
- If you attempt to use a Transponder without properly attaching it to your vehicle, you may incur an
administrative fee of $15 for each violation; be assessed civil penalties allowed by law for each
violation and be charged the full undiscounted toll.
- Administrative fees may be billed directly to your account. You may contest the imposition of
said administrative fees only in writing to the E-ZPass® Service Center. If the fee is rescinded, your
account will be credited the amount of the rescinded fee.
- The Authority may instruct the Motor Vehicle Administration (MVA) to suspend, or not to
renew, the motor-vehicle registration for non-payment or for chronic violations.
LOST/STOLEN OR DEFECTIVE TRANSPONDERS
You will not be liable for unauthorized use that occurs after you notify us, orally or in writing, of
loss, theft or possible unauthorized use. If your E-ZPass® Transponder(s) is/are non-operational for
reasons other than abuse or improper use, and the Transponder(s) is/are returned to us, we will replace
it/them at no charge to you.
DISCLAIMER
You acknowledge that E-ZPass® and all entities providing E-ZPass® services have
not made, and expressly disclaim, any representation or warranty, expressed or implied relating
to the Transponder including, without limitation, any implied or expressed warranty of merchantability, fitness
for a particular purpose or conformity to models or samples. You agree that E-ZPass®
and all entities providing E-ZPass® services will have no obligation or liability whatsoever
to you with respect to your use or the performance of the Transponder. You agree to indemnify and hold
harmless E-ZPass®, and all entities providing E-ZPass® services, from and against
all damage, loss, cost, expense or liability relating to, arising from, or resulting from, the use or
performance of the Transponder.
TERMINATION
You may terminate this agreement at any time. Just stop using your Transponder(s) and notify us in writing.
We will close your account and refund any balance to you after any outstanding charges
have been deducted. Commuter-plan accounts are not eligible for refunds.
COLLECTION OF EXPENSES
You agree to pay all costs, including attorneys’ fees, incurred by us to collect any funds due under the terms of this Agreement.
MODIFICATIONS
We may change the terms of this Customer Agreement at any time by advance written notice
with your monthly billing statement. You agree to a new term when you use your Transponder subsequent
to the effective date of the new term. The invalidity of any term or terms of this Agreement shall
not affect any other term of this Agreement, which shall remain in full force and effect. You agree
